- You may use Kaer only for things you have the right to do.
- Kaer agents act on your instructions — you are responsible for reviewing important plans, outputs, and actions.
- Kaer's infrastructure and primary storage are in the EU (Germany and Poland); some AI model providers and other sub-processors process data outside the EEA.
- Kaer uses interactions to improve the Service and train Kaer's own in-house models by default — you can opt out.
- Kaer does not sell your personal data and does not use Customer Data to train third-party foundation models.
- You own your Customer Data, and you own Output to the extent allowed by law and third-party model terms.
- Don't use Kaer for malware, phishing, CSAM, weapons, unauthorized access, IP infringement, or unattended high-impact decisions about other people.
- You can delete your account and export your data.
- Cancel a paid plan any time — prepaid unused time is refunded pro-rata unless a signed order says otherwise.
Agreement & acceptance
These Terms of Service (“Terms”) govern your access to and use of Kaer’s websites, apps, APIs, SDKs, agents, workflows, computer-use features, Mail AI, voice mode, paired-device features, PaerIDE/SuperWork, and related services (the “Service”).
By creating an account, using the Service, clicking to accept these Terms, or signing an order that references them, you agree to these Terms and to our Privacy Policy.
If you use Kaer on behalf of a company or other organisation, you represent that you have authority to bind that organisation, and “you” means both you and that organisation. You must be at least 16 years old to use the Service.

Accounts & security
You are responsible for your account, credentials, sessions, API keys, connected accounts, and the users you invite. You must provide accurate account information and keep it current.
You must protect passwords, devices, session cookies, API keys, OAuth grants, connector credentials, and paired-device approvals, and promptly notify [email protected] if you suspect unauthorised access, credential compromise, or misuse. You are responsible for activity under your account unless it resulted from Kaer’s breach of these Terms.
The Service & autonomous agents
Kaer provides autonomous AI agents that can chat, summarise, draft, classify, search, use tools, operate cloud sandboxes, interact with connected services, run workflows, process mail, use maps/travel features, and — with approval — execute tools on a Paired Device. Agents act on your instructions and configured permissions. You are responsible for:
- the instructions you give;
- the systems, services, data, files, mailboxes, repositories, APIs, and devices you connect;
- reviewing agent plans, outputs, and actions before relying on them;
- configuring approval gates, scopes, and permissions appropriate to the risk; and
- ensuring you have the right to process Customer Data and authorise agent actions.
Paired-device execution requires a hard human consent gate: a single-use approval key that expires after five minutes, which the model cannot grant itself. Mail-class tools cannot route to a Paired Device. Kaer may impose feature, safety, rate, usage, approval, or verification limits where needed to protect the Service, users, third parties, or legal compliance.
Acceptable use
You may not use the Service, or allow others to use it, to:
- create, distribute, request, facilitate, or access child sexual abuse material or sexual content involving minors;
- develop or facilitate malware, ransomware, credential theft, botnets, phishing, spam, evasion, vulnerability exploitation, or unauthorised access;
- access, test, scrape, scan, exfiltrate from, or interfere with systems, accounts, data, or networks without authorisation;
- generate or facilitate weapons or physical, biological, chemical, radiological, or explosive harm;
- harass, threaten, abuse, dox, stalk, exploit, or harm others, or impersonate others or deceive people about whether they are interacting with AI where disclosure is required;
- violate intellectual-property, privacy, publicity, contractual, export-control, sanctions, or other rights or laws;
- process personal data, mailboxes, files, browser traffic, credentials, or confidential information without authority;
- use agents to make unattended decisions about employment, housing, credit, insurance, education, criminal justice, healthcare, legal rights, or similarly significant matters affecting other people;
- present Output as final legal, medical, financial, tax, or other regulated advice without qualified human review;
- conduct surveillance, facial recognition, or biometric identification in ways that violate law or reasonable privacy expectations;
- overload, disrupt, reverse engineer, bypass, or attack the Service or Kaer’s safety, security, billing, rate-limit, or access controls; or
- resell or provide the Service as a competing platform without written permission.
Kaer may suspend or terminate access for violations of this section.
Customer Data, Output & IP
As between you and Kaer, you retain all rights in Customer Data. You grant Kaer a limited licence to host, copy, process, transmit, display, and use Customer Data as needed to provide, secure, support, improve, and operate the Service, comply with law, enforce these Terms, and as described in the Privacy Policy.
Subject to these Terms, applicable law, and any third-party model or service terms, Kaer assigns to you any rights Kaer has in Output generated for you. You are responsible for determining whether Output can be used, protected, published, licensed, or commercialised in your intended context.
You represent that you have all rights, permissions, and legal bases needed to submit Customer Data, connect services, use mailboxes, run agents, capture browser traffic, expose files or devices, and authorise processing by Kaer and its sub-processors. If you provide feedback or suggestions, you grant Kaer a perpetual, irrevocable, worldwide, royalty-free licence to use them.
AI output disclaimer
AI output may be incomplete, inaccurate, offensive, unsafe, duplicative, or unsuitable for your use case. Agents may misunderstand instructions, make incorrect assumptions, select the wrong tool, or take unintended actions if configured or approved to do so.
You must independently review and verify Output and agent actions before relying on them — especially for code, security, legal, medical, financial, tax, employment, travel, purchases, communications, or decisions affecting people. Kaer does not provide legal, medical, financial, tax, investment, or other professional advice, and Output is not a substitute for qualified professional judgement.
Third-party services & connectors
The Service can connect to third-party services such as Google, GitHub, Slack, Microsoft, Gmail, Outlook, Drive, Calendar, Sheets, Home Assistant, Telegram, Twilio SMS, Spotify, Todoist, Linear, Notion, Strava, Duffel, CoinGecko, Alpha Vantage, and map, search, payment, and model providers. When you connect or instruct Kaer to use a third-party service:
- you authorise Kaer to access, process, send, and receive data through that service as needed for your instructions;
- the third party’s own terms, privacy policy, rate limits, and security practices apply;
- you are responsible for having authority to connect the account or service;
- Kaer is not responsible for third-party services, content, outages, policy changes, or data practices; and
- you are responsible for costs or obligations those services impose on you unless Kaer expressly agrees otherwise.

Voice processing
If you use voice mode, you authorise Kaer to process microphone audio and transcripts to provide the requested feature. Where supported, voice features may run locally on your device; otherwise audio is processed by Kaer-operated speech-to-text systems or the processors listed in the Privacy Policy. Kaer does not store raw voice audio in the current voice flow. Transcripts are used to perform the requested interaction and may be retained only if they become part of a saved conversation or Customer Data record.
Service improvement & training
Kaer uses interactions, including prompts and responses, to improve the Service and train Kaer’s own in-house models. This setting is on by default, and you can opt out in account settings or by emailing [email protected]. Kaer does not sell personal data and does not use Customer Data to train third-party foundation models. See the Privacy Policy for detail.
Plans, billing, credits & taxes
Some features are free, trial, beta, usage-based, subscription-based, or available only on paid plans. Paid plans may bill monthly, annually, or under a signed order. Metered usage, compute, models, credits, storage, agent runs, and other usage-based charges may be billed in arrears or deducted from credits.
You authorise Kaer and Stripe to charge your payment method for applicable fees, usage, renewals, and taxes. Fees are exclusive of taxes unless stated otherwise, and you are responsible for taxes other than those on Kaer’s income. Kaer may change pricing, plans, credits, limits, or features with notice where required.
Refunds & cancellation
You may cancel a paid plan at any time. Unless a signed order says otherwise, Kaer will provide a prorated refund for the unused remainder of a prepaid term after cancellation. Usage-based, metered, overage, compute, and third-party pass-through charges already incurred are not refundable unless required by law. If fees are overdue, Kaer may suspend or limit access after reasonable notice.
Beta & experimental features
Kaer may offer beta, preview, trial, research, or experimental features. These may be incomplete, unstable, rate-limited, changed, or discontinued at any time, and may carry additional terms or data-handling disclosures. You should not use them for production, regulated, or high-impact use cases unless Kaer expressly agrees in writing.
Service levels & availability
Kaer targets 99.9% monthly availability for generally available paid Service components, measured excluding planned and emergency maintenance, beta features, customer-side or third-party failures, force-majeure events, misuse, and issues outside Kaer’s reasonable control. Live status is published at status.kaer.ai. Enterprise or signed-order service-level terms, if any, supersede this section for the covered customer and service.
Confidentiality
“Confidential Information” means non-public information disclosed by one party that is marked confidential or should reasonably be understood as confidential. Customer Data is your Confidential Information; non-public product, security, technical, financial, and business information about Kaer is Kaer’s. Each party will use the other’s Confidential Information only to perform or receive the Service, protect it with reasonable care, and disclose it only to people bound by confidentiality obligations. These obligations do not apply to information that is public through no fault of the recipient, already known without restriction, independently developed, or lawfully received from a third party. A party may disclose Confidential Information if required by law, with notice where legally permitted.
Kaer IP & restrictions
Kaer and its licensors own the Service, software, models, workflows, interfaces, designs, documentation, infrastructure, trade names, trademarks, and underlying technology. Except for the rights expressly granted in these Terms, Kaer reserves all rights. You may not copy, modify, reverse engineer, decompile, extract models from, benchmark for competitive purposes, bypass technical controls, or create derivative services from the Service except where law prohibits the restriction or Kaer gives written permission.
Warranty disclaimer
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Kaer disclaims all warranties — express, implied, statutory, or otherwise — including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted or error-free operation. Kaer does not warrant that Output will be accurate, lawful, safe, unique, protectable, or suitable for your use case.
Limitation of liability
To the fullest extent permitted by law, Kaer’s total liability arising out of or relating to the Service or these Terms will not exceed the fees you paid Kaer for the Service in the 12 months before the event giving rise to liability.
To the fullest extent permitted by law, Kaer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, goodwill, data, business, revenue, savings, or opportunities, even if advised of the possibility. These limits do not apply where liability cannot be limited by law, including for fraud, gross negligence, or wilful misconduct.
Indemnification
You will defend, indemnify, and hold harmless Kaer, its affiliates, and their officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising from:
- your Customer Data;
- your use of the Service, Output, connectors, paired devices, or third-party services;
- your violation of these Terms or applicable law;
- your infringement or misappropriation of third-party rights;
- your unauthorised processing of personal data, mail, files, credentials, browser traffic, or confidential information; or
- agent actions taken under your account, instructions, approvals, or connected services.
Term, termination & survival
These Terms begin when you first use the Service and continue until terminated. You may stop using the Service or delete your account at any time. Kaer may suspend or terminate access if you violate these Terms, create security or legal risk, fail to pay fees, misuse the Service, or if continuing to provide the Service would be unlawful or impractical. After termination, Kaer handles Customer Data as described in the Privacy Policy, any DPA, and your order. Sections that by their nature should survive will survive — including confidentiality, payment obligations, IP, disclaimers, limitations of liability, indemnification, dispute terms, and data-processing obligations.
Data Processing Addendum
Where Kaer processes personal data on behalf of a business customer, Kaer’s Data Processing Addendum applies if included in the customer’s agreement or requested for an eligible plan. The DPA covers processor/service-provider terms, sub-processors, security measures, international transfers, audit rights, and assistance with data-subject requests. Governing law & forum
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. If you are an EU or UK consumer, this choice of law and forum does not limit mandatory consumer-protection or privacy rights, or your right to bring claims in your local courts where applicable law gives you those rights. The parties will first try to resolve disputes informally via [email protected]; failing that, disputes will be resolved in the state or federal courts located in Delaware, unless mandatory law requires a different forum.
Changes to these Terms
Kaer may update these Terms as the Service, law, or business changes. For material changes, Kaer will provide at least 30 days’ notice by email, in-product notice, or another reasonable method before they take effect, unless a shorter period is required for legal, security, or operational reasons. Continued use after the effective date means you accept the updated Terms.
